Attorney Benjamin A Johnston practices exclusively in the area of Social Security Disability law and has done so since 2006. Mr. Johnston has also successfully represented claimants at the Appeals Council and Federal District Court levels.

A native of Salt Lake City, Utah, Mr. Johnston received his Bachelor of Science Degree in Psychology from the University of Utah in 1999. He attended the Sandra Day O’Conner College of Law at Arizona State University and received his Juris Doctor in 2006. While in law school, Mr. Johnston participated in the Disability Law Project, served as the Chapter Justice in the Black Chapter of Phi Alpha Delta, and volunteered as a mediator in Maricopa County Justice Courts.

After returning to Utah in 2006, Mr. Johnston was admitted to practice before all state and federal courts in Utah and in 2008 was admitted to the same in Nevada, though he is currently inactive in Nevada. In 2013, Mr. Johnston was nominated and admitted to practice before the United States Supreme Court. He has also been named to the Utah Business Magazine Legal Elite several times, most recently 2016 and 2017.

Under Social Security, we are trying to prove that you are unable to work on a full time basis. If you do work, it can complicate matters. Nevertheless, there are programs and guidelines to consider

Social Security has determined that if you are earning as a gross wage over $1,170 per month, then you are not disabled, no matter what is your medical condition. Social Security will closely monitor your work activities if your gross wages are $770 or more.

Wages is considered income coming from a employer for services rendered. If withholdings for Federal/State Taxes and Medicare are taken out, then it is a wage. If you are self employed, then it is the gross revenue less the necessary expenses. Some income is not considered a “wage”. This would include disability benefits, rental income, investment income or workers compensation benefits.
